Luxe Lifestyle and Entertainment - Terms of Service

Definitions

"Client" refers to any individual or entity requesting an artist, entertainer, or personal trainer through Luxe Lifestyle and Entertainment.
"Artist" refers to any performer, band, musician, or entertainer listed with Luxe Lifestyle and Entertainment.
"Personal Trainer" refers to fitness professionals offering private training sessions through Luxe Lifestyle and Entertainment.
"Engagement" refers to a booking of an Artist or Personal Trainer through Luxe Lifestyle and Entertainment.
"Booking Agreement" refers to the contract between the Client and the Artist or Personal Trainer facilitated by Luxe Lifestyle and Entertainment.
"Member Content" refers to all content submitted by Clients or Artists for marketing or profile purposes.

Luxe Lifestyle and Entertainment provides an online platform that connects Clients with Artists and Personal Trainers for events and private sessions (collectively, the "Services"). By using the Services, you agree to comply with and be legally bound by these Terms of Service ("Terms"). These Terms govern your use of the Services and constitute a binding legal agreement between you and Luxe Lifestyle and Entertainment.

Modifications

We reserve the right to modify these Terms at any time without prior notice. If we modify these Terms, we will post the updates on our website. Your continued use of our Services constitutes acceptance of the modified Terms.

How the Platform Works

Artists and Personal Trainers create profiles to be booked by Clients.
Clients can request bookings for entertainment or private training services.
Luxe Lifestyle and Entertainment acts solely as an intermediary and is not responsible for the performance, non-performance, or cancellation by any Artist or Personal Trainer.
The Client enters into a direct agreement with the Artist or Personal Trainer upon booking.
Luxe Lifestyle and Entertainment does not directly employ Artists or Personal Trainers but serves as a promotional and booking platform.
Luxe Lifestyle and Entertainment reserves the right to refuse service to anyone for any reason at its discretion.

Account Registration

To book an Artist or Personal Trainer, Clients must register and provide accurate information.
Luxe Lifestyle and Entertainment reserves the right to suspend or terminate accounts containing false or incomplete information.
Clients and Artists are responsible for safeguarding their account details and must notify Luxe Lifestyle and Entertainment of any unauthorized access.
Artists and Personal Trainers must maintain an active profile with accurate information regarding availability, pricing, and services offered.
Luxe Lifestyle and Entertainment reserves the right to remove any profile that violates our content guidelines or misrepresents the services provided.

Profiles & Listings

Luxe Lifestyle and Entertainment may create profiles for Artists using submitted content or publicly available material.
Artists are responsible for ensuring the accuracy of their profiles and compliance with applicable laws.
Luxe Lifestyle and Entertainment is not liable for the accuracy or reliability of any Artist’s profile.
Artists are not permitted to share or promote competing booking services on their profile.
Luxe Lifestyle and Entertainment reserves the right to modify or update profiles to improve visibility and quality.

Bookings and Financial Terms

Booking Confirmation: A booking is confirmed once a Client and an Artist or Personal Trainer agree to an Engagement.
Payment Terms: Clients must pay Luxe Lifestyle and Entertainment a percentage deposit at the time of booking, with the remaining balance due prior to the Engagement date.
Non-Refundable Deposit: Deposits are non-refundable unless cancellation is due to force majeure.
Final Payments: If a Client fails to make a final payment, the Engagement is canceled, and no refunds are provided.
Payment Processing: Luxe Lifestyle and Entertainment processes payments but does not guarantee the performance of Artists or Personal Trainers.
Date of Payment: The payment date must be decided between the Client and the Artist. The Client may require an invoice from the Artist, and payment can be made via bank transfer or cash on the night of the performance, as agreed between both parties.
Taxes: Artists and Personal Trainers are solely responsible for handling their own taxes in accordance with the tax laws of the country in which they perform. Luxe Lifestyle and Entertainment does not withhold or process taxes on behalf of Artists.

Cancellations and Refunds

If a Client cancels within 45 days of the Engagement, no refund is issued.
If an Artist or Personal Trainer cancels, Luxe Lifestyle and Entertainment will make reasonable efforts to provide a replacement but is under no obligation to do so.
If a booking is canceled due to Force Majeure, Luxe Lifestyle and Entertainment may refund up to 50% of the total fee at its discretion.
Luxe Lifestyle and Entertainment is not responsible for any additional costs incurred by cancellations, such as venue or travel expenses.
Clients are encouraged to obtain event insurance to protect against unexpected cancellations.

Client Responsibilities

Ensure the venue is equipped for live performances, including a safe power supply and proper licensing.
Provide necessary instruments, equipment, or accommodations as agreed upon with the Artist.
Ensure Artists or Personal Trainers are provided with refreshments and, if required, a secure changing area.
Communicate all requirements and expectations clearly prior to the Engagement to avoid disputes.

Re-Engagements

If a Client books an Artist through Luxe Lifestyle and Entertainment, they agree not to book that Artist privately for 12 months following the initial Engagement.
Artists may not bypass Luxe Lifestyle and Entertainment for direct bookings that originate through the platform.
Violation of this policy may result in removal from the platform and potential legal action.

Liability & Disclaimers

Luxe Lifestyle and Entertainment is not responsible for an Artist or Personal Trainer failing to perform, nor for any damages resulting from an Engagement.
Luxe Lifestyle and Entertainment does not endorse or guarantee any Artist or Personal Trainer's services.
Clients and Artists assume full liability for their agreements and any disputes arising from them.
Artists are solely responsible for handling their own taxes in accordance with the tax laws of the country in which they perform. Luxe Lifestyle and Entertainment does not withhold or process taxes on behalf of Artists.
Luxe Lifestyle and Entertainment is not liable for any damages, losses, or injuries incurred as a result of services booked through the platform.
Artists and Clients agree to resolve disputes directly between themselves before seeking mediation or legal action.

Luxe Lifestyle and Entertainment is not responsible for any third-party services, including venues, equipment rentals, or travel providers.

By using our Services, you acknowledge and agree to these Terms. If you do not agree to these Terms, you should refrain from using the platform.
